Terms and Conditions for the Alinta Energy ‘Bring the Energy’ In-Stadia Promotion 


1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. The Promoter is Alinta Energy Retail Sales Pty Limited (ABN 22 149 658 300) of Level 13, Grosvenor Place, 225 George Street, Sydney, NSW 2000 (“Promoter”).

3. “CA” is Cricket Australia (ABN 53 006 089 130) of 60 Jolimont Street, Jolimont, Victoria 3002.

4. Promotion commences on November 4th 2018 and concludes on February 4th 2019 (“Promotional Period”).

5. Subject to clause 5 of these Terms and Conditions, entry is only open to Australian residents who:
   (a) attend:
            a. any one of days 1 – 4 of a participating Test cricket match; 
            b. a participating men’s One Day International cricket match; or 
            c. a participating men’s T20 International cricket match,
                held during the Promotional Period (“Participating Match”);
    (b) are present in the main stadium seating area at a Participating Match; and 
    (c) cheer with energy and enthusiasm during the Bring the Energy Activity (as described in clause 6 of these   Terms and Conditions) at that Participating Match,
(“Eligible Entrants”).

Entrants under 18 years old (“Under 18 Entrant”) must have parental/guardian approval to enter and further, the parent/guardian of the Under 18 Entrant must read and consent to these Terms and Conditions in order for the Under 18 Entrant to be eligible for the Promotion. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the Under 18 Entrant  entering this promotion. If a parent/guardian does not approve to the entry, or read and consent to these Terms and Conditions, the Under 18 Entrant will be ineligible for the Prize.

6. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

7. To enter, Eligible Entrants must, during a 60 to 90 second period at a Participating Match (or, in the case of a Test match, during days 1 to 4 of that Participating Match, so long as there is play on that day) as selected by the Promoter at their absolute discretion, cheer with energy and enthusiasm when prompted to “bring the energy” by the ground announcer at the Venue (the “Bring the Energy Activity”).

8. At each Participating Match there will be one judge monitoring the Venue and the crowd from a location within the Venue (including on the field and at times in the production room). Subject to clause 14 below, the individual who, in the sole, subjective opinion of the judge during the Bring the Energy Activity, displayed the most enthusiastic and energetic cheering for each Participating Match will win the opportunity to meet a member of the Australian Cricket team (an “Australian Cricket Player”) at the end of that same day’s play (the “Prize”). Only one Prize will be awarded per Participating Match. If the Participating Match is a Test match, one Prize will be awarded on each day during days 1 – 4 of that Participating Match.

9. This is a game of skill and chance plays no part in determining the winners. 

10. The Promoter’s decision is final and no correspondence will be entered into. 

11. Winners will be notified in person, at the Participating Match, by a representative of Cricket Australia. The representative will collect the winner’s details so that the Prize can be awarded and coordinated.

General
12. If the winner of a prize is an Under 18 Entrant, they will need to be accompanied by a parent or guardian present with them at the game for the duration of the Prize. 

13. If for any reason a winner does not take up the Prize (or an element of the Prize) by the time stipulated by the Promote, then the Prize (or that element of the Prize) will be forfeited. The Prize cannot be transferred to a different date, time or location.

14. If any Prize (or part of any Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a Prize to the equal value and/or specification. 

15. The exact timing, duration of the Australian Cricket Player attending the Prize is at the sole discretion of Cricket Australia and the Promoter and is subject to availability, which may be impacted by circumstances such as – but not limited to- post match media, team meeting and recovery requirements

16. Total prize pool value is $500. Prizes, or any unused portion of a Prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

17. Entrants consent to the Promoter and CA using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or CA.

18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

19. The Promoter reserves the right, at any time, to request proof of the validity of entries and eligible entrants (including an entrant’s identity, age, place of residence or relationship to the Promoter) to claim a Prize and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter (acting reasonably). In the event that a winner cannot provide suitable proof, that winner will forfeit their Prize in whole and no substitute will be offered.

20. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) and CA (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

21. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) and CA (including its respective officers, employees and agents) are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s or CA’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or CA; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if a Participating Match is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of a Prize.

22. CA, on behalf of The Promoter, collects personal information ("PI") of winners in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.alintaenergy.com.au/qld/about-us/community-and-sponsorship/cricket-australia. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia. 

23. Cricket Australia reserves the right in its absolute discretion to change or amend the International Cricket fixture without notice. Neither the Promoter nor Cricket Australia accept responsibility for the cancellation or delay of any cricket match connected with this Promotion for any reason beyond the control of the Promoter or Cricket Australia.

24. By entering this promotion entrants agree to comply, and ensure that each subsequent ticket holder complies, with the ticket conditions which accompany any tickets won in conjunction with the promotion. Entrants also agree to comply, and ensure that each subsequent ticket holder complies, with Cricket Australia’s 2018/19 Ticket and Entry Conditions supplemented by any conditions of entry imposed by the venue operator. The Promoter will provide every person attending the match as part of the promotion with a copy of Cricket Australia’s 2018/19 Ticket and Entry Conditions with delivery of the prize tickets.
