Terms & Conditions for the “Win a Share of $10,000 in Bonus Credits” Promotion (Competition)
If you want to enter this Competition, these are the terms and conditions that will apply to you (Terms):
1. By submitting an entry into the Competition, you are deemed to have read, understood, and agreed to these Terms.
2. This Competition is promoted and run by Alinta Sales Pty Ltd (ABN 92 089 531 984), Level 18, 300 Murray Street, Perth WA 6000 and Alinta Energy Retail Sales Pty Ltd (ABN 22 149 658 300) Level 13, Level 13, 225 George Street, Sydney NSW 2000 (collectively the Promoter, otherwise referred to as us or we in these Terms).
What’s the Prize?
3. A total of 133 winners will be drawn as part of this Competition. The total value of prize is $10,000 AUD and divided and drawn in the order below:
$500 Account Credit – 2 Winners
$250 Account Credit – 6 Winners
$100 Account Credit – 25 Winners
$50 Account Credit – 100 Winners
If you’re drawn as a winner of this Competition, you will receive 1 x Account Credit to the relevant value (the Prize).
4. The Prize can’t be transferred to another person or energy account, nor exchanged for cash.
How do I enter?
5. You can enter the Competition by visiting alintaenergy.com.au/winbonuscredits and submitting the online entry form.
6. The Competition commences at 9am AEST 1 June 2024 and closes at 11.59pm AEST 31 August 2024 (Competition Period).
7. We must receive your entry before the Competition Period ends. Your entry is deemed to have been ‘received’ at the time our database records it as such.
8. Entries received after the Competition Period ends will automatically be deemed as invalid.
9. You are only allowed to submit one entry per account to the Competition. If you submit more than one entry, only your first submitted entry will be counted as valid.
10. We accept no responsibility for late, lost, or misdirected entries due to technical disruptions, network congestions, internet bogeymen, mercury being in retrograde, or any other reason.
Am I eligible to enter?
11. You’re only eligible to enter the Competition if you are an Eligible Entrant. You’ll be an Eligible Entrant if when entering you:
i. are:
a. an Australian resident;
b. at least 18 years old; and
c. the account holder of an active residential or small business Alinta Energy electricity and/or gas account;
ii. aren't:
a. an employee, agent, or contractor for the Promoter;
b. a relative of any employee, agent, or contractor of the Promoter (being a spouse, parent, step-parent, sibling or child of that employee, agent, or contractor); or
c. a former Alinta Energy customer who has cancelled their account or whose supply of gas/electricity has been cancelled by either the customer or Alinta Energy.
d. a recipient of any other gratuity above $75 in value (eg. gift card or hospitality) from the Promoter within a 6 month period prior to the draw date.
12. We reserve the right at any time to:
i. request proof that your entry is valid and that you’re an Eligible Entrant (including proof of your identity, age, place of residence, or relationship to an employee of the Promoter); and
ii. disqualify any Eligible Entrant who:
a. submits an entry form (where relevant) that doesn’t comply with these Terms; or
b. tampers with the entry process.
13. If you’ve made an error or an omission in your entry, it’s up to us in our discretion to decide whether or not to accept it as a valid entry.
How do I know if I’ve won?
14. We will draw the winners by random digital selection before 4:00pm (AEST) on Monday 2 September 2024 at the Alinta Energy office in Sydney (the Draw). You don’t need to be present at the Draw to be eligible to receive the Prize.
15. If you’re the winner, we’ll try notify you in writing using the contact details you provided us in your entry within seven days of the Draw.
16. However, we accept no responsibility for failing to notify you that you’ve won the Competition if we can’t reasonably reach you during ordinary business hours.
17. We’ll also publish the winners’ last name, first initial and postcode on the Alinta Energy website within 30 days of the Draw.
18. Once we notify you that you’ve won, you will need to claim the Prize within 30 days. Any unclaimed Prizes remain the Promoter’s property.
19. If we can’t reasonably get in touch with a winner, then we may conduct a second draw and award the Prize to a substitute winner. The Unclaimed Prize Draw will be conducted at 2:00pm (AEST) on Wednesday 3 October 2024 at the Alinta Energy office in Sydney. The substitute winner(s) will be notified in writing using the contact details provided to us in your entry within seven days of the Unclaimed Prize Draw. If the prize is $250 or greater, we’ll also publish the substitute winners’ last name, first initial and postcode on the Alinta Energy website within 30 days of the Draw.
20. Our decisions regarding how to conduct the Competition, complete the Draw, and determine the winner are final and cannot be contested.
How are you using the personal information I submit in my entry?
21. By entering the Competition, you consent to:
i. us publishing your name and other information for the purposes of us promoting the Competition and our business. For example, if you win the Competition, we will publish your first name and suburb, on our website or in our newsletters without providing any remuneration to you;
ii. us using any promotional pictures or videos we might take of you during an event on an ongoing basis without providing any royalties to you, if the Competition relates to a specific event (including where you might feature as the star of those photos or videos, or where you might just be part of a bigger crowd);
iii. your personal information (including name, address, telephone number and email address) being used for future marketing purposes in accordance with our privacy policy, which is available on Alinta Energy’s website at www.alintaenergy.com.au/privacy; and
iv. being contacted from time to time, including through electronic means and/or telephone, to be kept informed about our products and offers, even after your energy plan has ended, unless you opt out by contacting us in accordance with the approach set out in our privacy policy or by clicking the unsubscribe link contained in all our marketing emails.
Other important legal information
22. We may terminate, vary, or suspend the Promotion in:
i. accordance with the relevant governing laws in the state in which the Promotion is being conducted;
ii. circumstances not within the Promoter’s reasonable control or foreseeability, subject to any written direction from a relevant regulatory authority (Force Majeure Event). Force Majeure Events include (but aren’t limited to) any act of war, terrorism, public health event, or natural disaster in Australia.
23. If we don’t enforce our rights force any of our rights under these Terms or at law at any stage, that doesn’t constitute a waiver of those rights.
24. Winners accept all risks, responsibilities, and restrictions associated with accepting and using the Prize. To the maximum extent permitted by law, neither the Promoter, nor any of their respective related bodies corporate or their respective officers, employees, agents or contractors accepts or otherwise has any responsibility for any loss, damage, accident, death or injury resulting from or arising out of or in any way connected with the Promotion.
25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties or similar consumer protection laws in Western Australia.
26. This competition is authorised under SA Permit T24/666.
27. This is a game of chance and skill plays no part in determining the winner.
