Terms & Conditions for the “Alinta Energy Community Grants Program”

1. By submitting an entry to the Alinta Energy Yandin Wind Farm Community Fund (Program), entrants accept and agree to these terms and conditions (Terms and Conditions).
2. The Promoter is Alinta Servco Pty Ltd (Alinta Energy),  Level 18 Raine Square, 300 Murray Street, Perth WA 6000 (ABN) (Promoter).
3. The Program commences at 9.00am WST on Monday 5 August 2019 and closes at 11.59pm WST on Sunday 8 September 2019.

Eligibility

4. Subject to clause 4 of these Terms and Conditions, entry into this program is only open to community groups  who are:

a. a not-for profit or unincorporated group or organisation;
b. located and operate in the Dandaragan Region;
c. seeking funding to help them make a positive difference in their local area,
(Eligible Entrant).

5. An Eligible Entrant excludes any:

a. individual and their personal projects;
b. businesses and groups that generate a profit;
c. individual or team participants in large scale fundraising events;
d. community groups that are involved with discriminatory, political or religious organisation;
e. community groups that are involved with hazardous or dangerous activities.

Entry

6. The entry form must be submitted on behalf of the Eligible Entrant by an authorised representative whom:

a. is a resident of Dandaragan;
b. is authorised by the Eligible Entrant to enter the Program, give consents and make decisions on behalf of the Eligible Entrant;
c. is aged eighteen (18) years or older as at the time of entry; and
d. is an active member of the Eligible Entrant.

7. To enter, an authorised representative of the Eligible Entrant must complete and submit an online entry form at alintaenergy.com.au/yandinwindfarm.
8. Eligible Entrants may submit an application for entry into the Program prior to 11:59pm (WST) on Sunday 8 Septeber 2019 Entries submitted by Eligible Entrants received after this date will not be eligible.
9. Alinta Energy reserves the right to modify the Promotion Period. 
10. The individual nominated on the application form will be sent email communications on behalf of the Eligible Entrant regarding the process of their entry into the Program.
11. There is a limit of one application on behalf of an Eligible Entrant during any Promotional Period. The first application made by the Eligible Entrant during a specific Promotional Period will be taken to be the Eligible Entrant’s first and final entry.
12. A group photograph of each Eligible Entrant must be submitted with the application. Alinta Energy has permission to use this image without restriction.
13. Incomplete or indecipherable entries will be deemed invalid and will be rejected.
14. Promoter reserves the right to verify the validity of the entries and disqualify entries in its absolute discretion.
15. The Promoter accepts no responsibility for late, lost or misdirected entries due to technical disruptions, network congestions or any other reason.

Selection

16. For each Promotion Period, applications by Eligible Entrants will be reviewed and shortlisted. Not all applications that meet the eligibility criteria will be shortlisted.
17. The panel selected by Alinta Energy will review the shortlisted applications and select, in their absolute discretion, the entry/entries they believe most closely align with the selection criteria which can be amended from time to time.
18. The panel will convene on a regular basis after the Promotion Periods ends and determine the successful entrants.
19. There may be one, multiple or no successful entrants for each Promotion Period. Successful entrants will be notified by email no later than three business days after selection. The details of any successful entrants will be published on the Promoter’s website as soon as reasonably practicable after selection.
20. The Program consists of a grant pool of up to $25,000 (per Promotion Period), to be allocated at the panel’s discretion in each Promotion Period. The grant amount each successful Eligible Entrant receives (Grant) will be at the panel’s discretion. The total grant pool may not be allocated in the Promotional Period.
21. The Promoter’s decision regarding the determination of the Grant recipients and the conduct of the Program is final and cannot be contested. No correspondence shall be entered into.
22. Successful Eligible Entrants must provide the Promoter with an invoice for the amount of the Grant, following which the amount of the Grant will be deposited into the successful Eligible Entrant’s bank account as soon as reasonably practicable. Payments will only be paid into a bank account in the successful Eligible Entrant’s name. Personal bank accounts are not acceptable.
23. The successful Eligible Entrant must use the Grant strictly in accordance with the activities outlined on the Eligible Entrant’s application form. The successful Eligible Entrant must provide a report to the Promoter describing the way in which the Grant has been spent in accordance with the activities outlined on the application form, failing which the Promoter may require the recipient of the Grant to repay the amount of the Grant.
24. If the Grant remains unclaimed by the successful Eligible Entrant failing to send an invoice to the Promoter for the amount of the Grant within 3 months of being notified of selection, the Grant will be forfeited.
25. Recipients of the Grant accept all risks, responsibilities and restrictions associated with the acceptance and use of the Grant by themselves and anyone else. To the maximum extent permitted by law, neither the Promoter, nor any of their respective related bodies corporate or their respective officers, employees, agents or contractors accepts or otherwise has any responsibility for any loss, damage, accident, death or injury resulting from or arising out of or in any way connected with the Grant.

Marketing Purposes

26. The Eligible Entrant grants the Promoter permission to use their entry and the information provided within, in whole or in part, in accordance with these terms and conditions. The entry can be used by Alinta Energy in any media for an unlimited time for any purpose.
27. Entry details remain the property of the Promoter. The name and photographs of the successful Eligible Entrant and its members may be used for promotional purposes by the Promoter, unless the successful Eligible Entrant otherwise notifies the Promoter at the time of accepting the Grant. Entrants consent to the Promoter using any personal information collected in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any grants.
28. Recipients of the Grant and its members must be willing to participate in activities for publicity purposes without any remuneration. 
29. Individuals forming part of the community group will be required to sign a media release form as required by Alinta Energy.
30. Entrants must not use the Promoter’s logo or brand without the prior written consent of the Promoter.

General

31. Alinta Energy reserves the right to modify, suspend or terminate the Program at any time.
32. The Promoter accepts no responsibility for any tax implications that may arise from accepting the Grant.
33. Failure to adhere to any of these Terms and Conditions may result in the Promoter withdrawing or requiring the repayment of a Grant, without any compensation payable.
34. The Grant cannot be transferred to any other group or organisation.  If a Grant cannot be used in accordance with the activities outlined on the application form, or for any other reason, the recipient of the Grant must notify Alinta Energy as soon as practicable and Alinta Energy may require the recipient of the Grant to forfeit and/or repay the Grant.
