Terms & Conditions for the “Alinta Energy Grass Roots Cricket Promotion” (“Competition”)

*See item 8 below for prize description

  1. Entrants to the Competition (both members and clubs) are taken to accept and agree to abide by these Terms and Conditions.
  2. The Promoter of the Competition is Alinta Energy Retail Sales Pty Limited (ABN 22 149 658 300) of Level 13, Grosvenor Place, 225 George Street, Sydney, NSW 2000 (Promoter).
  3. The Competition dates are as follows:
  1. Phase 1 of Competition commences at 9:00 (AEST) on Friday 16 October 2020 and closes at 16:00 (AEST) on Sunday 6 December 2020; and
  2. Phase 2 of Competition commences at 9:00 (AEST) on Monday 11 January 2021 and closes at 16:00 (AEST) on Sunday 7 March 2021,

(together the Competition Period).

  1. Entry into this Competition is only open to cricket clubs in New South Wales, Victoria, South Australia, Queensland or Western Australia, which are officially registered on the MyCricket platform, that have a minimum of ten (10) or more club members (Members) sign-up to the CA Family & Friends offer (Eligible Entrant). These Members must each be:
  1. a resident of New South Wales, Victoria, South Australia, Queensland or Western Australia; and
  2. the account holder of an active residential electricity and/or gas Alinta Energy CA Family & Friends Offer Account:
  1. whose name appears on the electricity and/or gas bill as at the date of the draw, or
  2. who have signed up to a new active residential electricity and/or gas Alinta Energy CA Family & Friends Offer Account using an invitation link by 6 December 2020 (Phase 1) or 7 March 2021 (Phase 2) and nominated the cricket.
  1. A club will only become an Eligible Entrant and commence earning entries into each phase of the competition once a minimum of ten (10) Members sign-up to the CA Family & Friends offer, following which each Eligible Entrant will earn one (1) entry into the prize draw during the respective Phase of the Competition Period. To enter the prize draws for each of Phase 1 and Phase 2 the minimum number of Members must sign up for a club to be an Eligible Entrant in each respective phase.
  2. Only one entry into this competition is allowed per Member.
  3. The time of the entry will be the time the entry form is received by the Promoter’s database. Entries received after the Competition Period will automatically be deemed as invalid. The Promoter accepts no responsibility for late, lost or misdirected entries due to technical disruptions, network congestions or any other reason.
  4. There will be 2 promotional periods (Phase 1 and Phase 2) and 2 draws (one for Phase 1 and one for Phase 2):
  1. In Phase 1 there will be three Prize winners (nationally), which will each receive $5,000 to be credited to their nominated account in accordance with clause 15; and
  2. In Phase 2 there will be two Prize winners (nationally), which will each receive $5,000 to be credited to their nominated account in accordance with clause 15.
  1. The draws for each phase will take place as follows:
  1. For Phase 1, the draw will take place by random digital selection at 10:30am (AEST) on Thursday 10 December 2020 and the winning clubs will be notified by email and/or phone using the details registered with Cricket Australia. The draw will take place at the Alinta Energy office in Sydney unless the office is not able to be accessed on the date of the draw (for example due to COVID-19), in which case the draw will take place at an alternate Alinta Energy office.
  2. For Phase 2, the draw will take place by random digital selection at 10:30am (AEST) on Thursday 11 March 2021 and the winning clubs will be notified by email and/or phone using the details registered with Cricket Australia. The draw will take place at the Alinta Energy office in Sydney unless the office is not able to be accessed on the date of the draw (for example due to COVID-19), in which case the draw will take place at an alternate Alinta Energy office.
  1. For the Phase 1 prize draw, the first three valid club names drawn will have $5,000 credited to their cricket club account by Thursday 17 December 2020.
  2. The entries from all non-winning Eligible Entrants who entered Phase 1 of the competition will be automatically placed into Phase 2 of the draw.
  3. For the Phase 2 prize draw, the first three valid club names drawn will receive $5,000 credited to their cricket club account by Thursday 18 March 2021.
  4. A bonus prize of $3,000 will be awarded to the cricket club (which is an Eligible Entrant) with the highest number of Member sign-ups at the close of the Competition Period (being 7 March 2021). The bonus prize will be credited to the cricket club’s account by Thursday 18 March 2021.
  5. The maximum prize amount for each cricket club winner from the Phase 1 and Phase 2 draws is $5,000 (including GST). A cricket club can win an additional $3,000 if they are also the cricket club with the highest number of Member sign-ups at the close of the Competition Period. The total prize pool for Phase 1, Phase 2 and bonus prize is $28,000.
  6. The 5 x $5,000 cash prizes and 1 x $3,000 bonus cash prize must be credited to the pre-selected cricket club accounts. Winning clubs will need to complete and return a banking details form with their club/association’s bank account details. By completing this form, each winning Eligible Entrant acknowledges that the funds awarded are to be used for the purpose of sustaining operations of the cricket club/association and are not for individual use. If at any stage it is determined that the winning Eligible Entrant has used the funds for an improper purpose, the winning Eligible Entrant may be held liable for full repayment of the awarded amount. Prize fulfilment can be expected within 7 working days of returning the completed form.
  7. The Promoter reserves the right, at any time, to request proof of the validity of entries and Eligible Entrants to claim a prize and to disqualify any entrant who submits an entry form that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  8. The Promoter will endeavour to notify the winners by email or telephone within 2 weeks of the draw. The Promoter accepts no responsibility for failure to notify a winner if that winner is not reasonably contactable. The prize must be claimed within 30 days of the Draw. Any unclaimed prizes remain the property of the Promoter.
  9. The Promoter’s decision regarding the Draw, determination of the winners and the conduct of the Competition is final and cannot be contested. No correspondence shall be entered into.
  10. The Competition winners each consent to the Promoter using the club name, suburb, club logo and any photos of the club and its members (such photos to be pre-approved by the Competition winner) for publicity purposes without any remuneration.
  11. The winning club names will be listed on the Alinta Energy website and the MyCricket Facebook page as soon as reasonably practicable after the Draw.
  12. In the case of any force majeure event or circumstance not reasonably within the control of the Promoter and which by the reasonable exercise of due diligence the Promoter is not reasonably able to prevent or overcome, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or value or type of Prize, subject to any written direction from a relevant regulatory authority (“Force Majeure Event”). Without limiting the generality of the nature of those events, a Force Majeure Event includes any act of war, terrorism or natural disaster in Australia.
  13. Winners accept all risks, responsibilities and restrictions associated with the acceptance and use of the Prize by themselves and anyone else. To the maximum extent permitted by law, neither the Promoter, nor any of their respective related bodies corporate or their respective officers, employees, agents or contractors accepts or otherwise has any responsibility for any loss, damage, accident, death or injury resulting from or arising out of or in any way connected with the Competition. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 of Australia, as well as any other implied warranties or similar consumer protection laws in the States and Territories of Australia.
